India made mistake by moving ICJ over Kulbhushan: Ex- Indian CJ

Pakistan will challenge the jurisdiction of International Court of Justice (ICJ) through its declaration, according to sources.

Interior minister Chaudhry Nisar Ali Khan said Jadhav's case would be taken to its "logical conclusion" according to Pakistan's Constitution and laws.

Earlier this week, the ICJ had ordered a stay in the execution of Kulbhushan Jadhav, the self-confessed Indian spy convicted by Pakistan for carrying out subversive activities in the country.

ICJ announced its verdict on May 18 pronouncing that Pakistan should not execute Jadhav until final decision of the court, and that he should be granted consular access. They also stressed on the requirement for Pakistan to produce evidence of proper trial which it claimed to have conducted in the case.

Aziz said the ICJ had given its point of view on Jadhav's case to get consular access.

Notably, the Jadhav ICJ case falls under the ambit of Aziz, who is Pakistan's de factor foreign minister.

"Issuing stay order on execution is normal".

Aziz said the Kashmir issue would not be taken to ICJ as it is being dealt at the higher forum of UN Security Council.

A case was also registered under Foreigners Act 1946 and the arrested person, who hails from Jogeshwari East in Mumbai, has been transferred to jail for judicial remand, the daily said.

This was reported by the Pakistan state radio, which quoted a top ruling politician.

A Pakistani military court had sentenced Jadhav to death in March after he allegedly to his crimes.

Pakistan alleged the former Indian Navy officer was involved in spying and terror activities in Balochistan. "Now it is certain that Pakistan will approach the ICJ for deciding the Kashmir dispute, and it will then hardly lie in our mouth to object to the jurisdiction of ICJ, since we can not blow hot and cold together", he said.

Pakistan is to drag India to International Court of Justice (ICJ) over Kashmir dispute, sources reported on Friday.
