Cosby defense rests without calling the comedian to testify

Bill Cosby arrived at court Monday morning for Day 6 of his sexual assault trial and the start of the defense side of the case, accompanied for the first time by his wife of 53 years, Camille. They asked the judge to repeat two different parts of Cosby's statements to authorities, asked the court to define the phrase "without her knowledge" in one of the charges, and asked to hear repeat testimony from the Canadian detective who interviewed Constand.

One of the detectives who led the 2005 investigation into the sitcom star testified about the claims made by Andrea Constand that Cosby drugged and molested her in his Philadelphia home in 2004.

"Drugging somebody and putting them in a position where you can do what you want with them is not romantic", he added. "It's criminal", District Attorney Kevin Steele said.

"I have three friends for you to make you relax", Cosby said he told Constand, according to a deposition transcript re-read to the jury Monday night.

In the prosecution's closing argument, Steele said that Cosby's lurid statements from 2005 helped corroborate Constand's allegations.

Victims' right groups have said Constand is a flashpoint for a larger cause but that it does not diminish her case.

Next, instructions are expected to be given to the jury, which will decide on the three counts of aggravated indecent assault.

The case has sparked debate over celebrity, race, power and gender.

"Just tell the truth - what are we doing here?" he continued, one of many exclamations he made in a fiery and at times histrionic closing that lasted almost two hours.

A few steps behind Cosby, who sat at the defence table reclining in his chair, the comic legend's wife, Camille, watched McMonagle's closing argument.

He also said she phoned Cosby dozens of times after the alleged assault.

The lawyer grew especially excited when he displayed a statement from Constand that the night of the alleged assault, she called Cosby from the street to tell him she was at his home and ask to be let into the driveway.

"Don't leave your common sense in Pittsburgh."This isn't talking to a trustee". "Why are we running from the truth of this case - this relationship? Why?"

On Monday, for the first time, Cosby, 79 and almost blind, was accompanied to court by his wife of more than 50 years, Camille. She was stoic during the defense argument but left when it was the prosecution's turn.

Constand testified that the assault left her humiliated by someone she had thought of as a friend and mentor.

Andrea Constand says Cosby gave her pills that made her paralyzed and unable to fight him off as he groped her breast and genitals.

Mr Cosby denies the charge and his lawyer has said she agreed to sex.

He told Judge Steven O'Neill that he had decided not to testify after speaking with his lawyers.

McMonagle defended the good faith of his client, saying Cosby had agreed to speak at length to investigators in 2005 when he could have kept silent, and rounded on the press.

Phone records showed she made no such call in January, he said, and instead show she only called Cosby's phone numbers in NY.

" 'We're not flawless, are we?' he said, pausing and looking at Camille Cosby, 73".

Steele also reminded jurors about a telephone conversation in which Cosby apologized to Constand's mother and described himself as a "sick man".

"All the fancy lawyering you have can't get you around your own words", Steele said.

Cosby acknowledged that he obtained Quaaludes, a prescription sedative, in the 1970s to give to young women.

He also said he gave Ms Constand three half-tablets of the cold and allergy medicine Benadryl before the "petting" began. Legal experts and courtroom observers generally dismissed that suggestion as a bluff, perhaps created to throw prosecutors - who ended with a lot of momentum - off balance.

The sequestered panel deliberated for about four hours late Monday before asking to go back to the hotel.

"This is two people, totally separate, never met each other, but look at all the similarities in terms of what happened, the sexual assault they both experienced and how in Kelly's case, she found her dress down and her shirt above her waist, Andrea with her clothes disheveled", Steele said.
