Cosby jury sent home after deliberating 4 hours

U.S. comedian Bill Cosby's defence lawyers have rested their case after presenting a single, brief witness in his sexual assault trial. He is charged with three counts of aggravated indecent assault, each of which carries a possible 10-year sentence.

The fate of Bill Cosby lay in the hands of a United States jury who deliberated over dinner and into the night on whether or not the disgraced entertainer sexually assaulted a woman at his home more than 13 years ago.

The defense rested Monday afternoon and his attorney called the plaintiff, Andrea Constand, a liar in a almost two-hour closing argument.

Bill Cosby is accused of drugging and groping 44-year-old Andrea Constand at the comedian's come outside Philadelphia in 2004.

Cosby maintained only that he gave Constand the antihistamine Benadryl to relieve stress, and that they had consensual sexual relations, accusing her of lying. He also pointed out that Constand spoke by phone with Cosby numerous times after the alleged assault. Then pointing to Cosby's wife, Camille, who appeared in court for the first time Monday, McMonagle said: "And she deserved better". Monday was the first day she had joined her husband in court since the trial started June 5.

He said Constand told police in her first interview that she had never been alone with Cosby before the alleged attack, but later admitted she had spent time alone with him at his home and at a CT resort. Steele also reminded jurors that Cosby had admitted to giving quaaludes, a powerful now-illegal sedative, to women with whom he wanted to have sex.

Last week the prosecution spent days laying out the case against Cosby, calling 12 witnesses to the stand.

McMonagle, in his closing argument, tried to sow doubt about Constand's story, saying it had evolved during her interviews with police. Instead, his defense consisted of a roughly six-minute appearance by Cheltenham Township Police Department Sergeant Richard Schaffer, who led the 2005 investigation into allegations Cosby drugged and sexually assaulted Constand at the comic's suburban Philadelphia home in 2004.

The jury that will determine Bill Cosby's fate called it quits without coming to a verdict late Monday, following four hours and 20 minutes of deliberations.

None of the other women's accusations has resulted in prosecution - in many cases, too much time has passed - leaving Ms Constand's case as the only formal test of Mr Cosby's guilt. He has repeatedly denied wrongdoing and described his encounter with Constand as consensual.

"One of the greatest storytellers in the world and I'm failing", Cosby said when asked to repeat an answer in the deposition. Prosecutors and police detectives read aloud portions of Cosby's statements to police in 2005 and in a civil deposition in 2006.

Cosby says he gave Constand a cold and allergy medicine to help her relax.

The comedian could spend the rest of his life in prison if convicted.

" 'We're not flawless, are we?' he said, pausing and looking at Camille Cosby, 73".

ALLYN: Outside the courtroom, Cosby's spokesman, Andrew Wyatt, said those little details undercut the accuser's credibility.

Cosby's testimony in her civil case shows just how hard a witness he would have been to control.

McMonagle said he was working to "right a bad wrong" by representing Cosby, and said jurors looking to do the same should return a verdict of not guilty. He said prosecutors are ignoring the conflicting information, hoping to distort Cosby's legacy.

And all along, they said Constand was a willing romantic partner.

For the prosecution's closing statement, Steele argued that Cosby's own statements showed his guilt.

"This isn't talking to a trustee".

The defence case consisted of a six-minute appearance by a detective, seemingly created to remind jurors that Andrea Constand had visited with Cosby at an out-of-state casino and that police knew he had vision problems even then.

The Associated Press does not typically identify people who say they are victims of sexual assault unless they grant permission, which Constand and Johnson have done. She sat in the front row, across the aisle from Constand, who didn't react to McMonagle's two-hour closing but smiled at the end of it.
