Rape Victim Asks Judge To End Polanski Case

Samantha Geimer asked Los Angeles Superior Court Judge Scott Gordon to either dismiss the unlawful sex with a minor case against Polanski, or issue a sentence without Polanski present.

Samantha Geimer, 54, made her first public court appearance in the matter and told Judge Scott Gordon she supports either an outright dismissal or a hearing that would sentence Polanski without his having to appear in person. She said that she was exhausted of prosecutors using a crime committed against her used by them to further their careers.

Polanski reportedly wants to return to the United States to visit the grave of his late wife Sharon Tate, who was murdered in 1969 by members of the Charles Manson family when she was eight months pregnant.

Polanski's attorney, Harland Braun, is seeking the release of a sealed transcript of testimony from former prosecutor Roger Gunson, which he believes will show that Polanski was mistreated by the court in 1979.

But Deputy District Attorney Michele Hanisee rejected the victim's motion to dismiss the case, arguing that it is in Polanski's hands to return to the country to end the ordeal. At a news conference after the court hearing Friday, she said she was offended when she read his 1984 autobiography, in which he described their encounter as consensual.

She said Gordon could also unseal documents that Polanski claims prove he had struck a deal with the initial judge in the case. To other sex crime victims, she said: "Do your best to recover". A lawyer for Polanski says Geimer, a sex crime victim, will appeal to a judge to end the case against him. "He owes me nothing". The United States has attempted several times to extradite him from Europe to face justice, and more jail time, in California. "The insults have switched, but I have empathy for the way he's treated because I was treated the same way when this first happened". The judge is just playing games with him, " Braun added. He has been overseas since his flight 39 years ago; the warrant even kept him from the 2003 Academy Awards ceremony when he won an Oscar for "The Pianist".

The director of "Rosemary's Baby" and "Chinatown" was accused of drugging the 13-year-old Geimer before raping her at the house of film star Jack Nicholson in Los Angeles. Nicholson was not home at the time. If Gordon was skeptical of Polanski's arguments, however, he was solicitous of Geimer, who flew in to testify on Polanksi's behalf. CNN does not normally identify sexual assault victims, but Geimer identified herself publicly years ago. The cover features a photo shot by Polanski.

Tamar Arminak, Bynes' attorney, said Bynes has complied with all conditions of her probation from the series of driving violations which included a DUI, two alleged hit-and-run incidents, tickets and driver's license suspension.

The original judge in Roman Polanski's rape case promised the director he would "serve 90 days of psychiatric evaluation".

She said Friday's hearing may be her last chance to directly address a judge about her wishes.
