Woman says Cosby accuser hatched plan to sue

Bill Cosby arrives for his sexual assault trial at the Montgomery County Courthouse in Norristown Pa. Tuesday

Nonetheless, the comedian whose storytelling artistry fueled a $400 million fortune went quiet when he had the chance to take the stand, unwilling to risk cross-examination about his 60 other accusers if he denied ever drugging or molesting anyone.

Constand either lied to police or committed perjury - regardless, the jurors must decide which truth, or lie, to believe.

In the deposition, Cosby said he gave her Benedryl, a non-prescription allergy medication as he and Constand talked in the kitchen of his home that night.

He also said the pills he gave her were over-the-counter Benadryl, which he admitted can cause sleepiness. Although Cosby has not been convicted of sexual assault, it does not at all give anyone a right to attack his accuser, nor accuse her of lying or facilitating her own assault.

She claims he gave her three blue pills, which he described as "little friends", before sexually assaulting her. The defence started and ended its case Monday with six minutes of repeat testimony from a detective.

"I was really nervous and wasn't able to recall every particular moment that I had seen Mr. Cosby in order of dates", she explained.

Judge Steven O'Neill said the jury had the written charge in its possession and that he is not permitted to define the charges any further.

Cosby did not testify but his past deposition was read aloud in court.

He is being accused of drugging and raping Constand at his Elkins Park home back in January of 2004.

In addition, Constand initially told police that she had not been alone with Cosby prior to the alleged assault and that they had little contact after.

As he described reaching into Constand's trousers, Cosby testified, "I go into the area that is somewhere between permission and rejection". Cosby is charged with three counts of aggravated sexual assault, each with slightly different criteria for arriving at guilty verdict. The testimony, unsealed in 2015 at the request of The Associated Press, wasn't pretty coming from the beloved TV dad. His accuser Constand, her mother, and another accuser, Kelly Johnson, took the stand.

Constand is one of dozens of women to have accused Cosby of sex abuse - often after plying them with drugs - in a series of incidents dating to the 1960s.

Cosby, 79, is charged with three counts of felony aggravated indecent assault, each of which carries a possible prison sentence of from five to 10 years.

The defense had tried repeatedly since Cosby's December 30, 2015, arrest to have the case shut down, saying the charges were filed too late and the accusers were after money.

"We're here because of them", he said, pointing to the benches of reporters covering the trial. They also complained that prosecutors improperly struck blacks from the jury chosen in Pittsburgh. She testified the entertainer led her to a couch and she quickly became incapacitated and felt paralyzed as Cosby groped her breasts, inserted his finger in her and put her hand on his penis. Victim blaming of those who report sexual assault is not only cruel and unfair to the victim, but also further entrenches the notion that people should not report their assaults, since they may subsequently be blamed for them. The counts applied in the commonwealth's case address the lack of consent, delivery of an intoxicating substance and her unconscious state.

Ms Constand, the 44-year-old at the centre of the case, settled a civil lawsuit with the embattled star in 2006 and was given an undisclosed cash sum.

If convicted, Cosby could remain free until sentencing unless Judge Steven O'Neill revokes his $1 million U.S. bail.
